Agreement to Terms

By downloading, installing, or using Capone’s Bones (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

Capone’s Bones is a mobile dice game application that provides:

• Single-player, local multiplayer (Bluetooth), and online multiplayer game modes
• In-app purchases for virtual currency (“Dough”) and premium features
• Leaderboards and awards
• Social features and online gameplay

Some features (for example, solo practice, local multiplayer) may be used without creating an account. An account is required for online play, daily rewards, awards, and purchases.

Beta, TestFlight, and preview builds

We may offer pre-release or beta versions through Apple TestFlight, Google Play testing programs, or similar distribution. Those builds are still governed by these Terms and our Privacy Policy.

Beta builds may differ from the store release (for example test advertisements, feature flags, or non-production labels). Do not assume feature completeness, balance, or availability in a beta will match the shipping product. We may end or change beta access at any time. Feedback you provide may be used to improve the app without obligation to you.

Eligibility

• You must comply with the laws of your jurisdiction when using the app.
• You must be at least 13 years old to create an account.
• If you are under the age of majority where you live, you must have permission from a parent or legal guardian to use the app.

User Accounts

Account Creation

• You may create an account using email, Google, or Apple authentication
• You are responsible for maintaining the confidentiality of your account
• You must be at least 13 years old to create an account

Account Responsibilities

• You are responsible for all activities under your account
• You must immediately notify us of any unauthorized use
• We reserve the right to suspend or terminate accounts that violate these Terms

In-App Purchases

Purchases are processed only by Apple or Google through their respective stores. Product types may include consumables (for example virtual currency), non-consumable unlocks, and any auto-renewing or non-renewing subscriptions we offer in the store; subscription billing, renewal, and cancellation follow the platform’s subscription rules and your store account settings.

Virtual Currency

• The App includes virtual currency (“Dough”) that can be purchased with real money
• Virtual currency has no real-world value and cannot be exchanged for cash
• All purchases are final and non-refundable, except as required by law
• The App does not offer gambling. Virtual currency and in-game rewards are for entertainment only; they do not constitute real-money gaming
• Virtual items, progression, and unlocks may be adjusted, rebalanced, or retired as the app evolves

Premium Features

• Premium features may be purchased through in-app purchases
• Premium features are tied to your account and device
• We reserve the right to modify or discontinue premium features

Refunds

• Refund requests must comply with Apple App Store or Google Play Store policies
• We are not responsible for processing refunds directly
• Contact Apple or Google support for refund requests

Multiplayer and Fair Play

To help keep gameplay fair, you agree not to:

• Exploit bugs, matchmaking systems, or ranking systems
• Use bots, scripts, macros, or automation
• Harass, impersonate, or abuse other players
• Manipulate purchases, ads, rewards, or progression systems
• Attempt to bypass platform, account, or device restrictions

User Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to hack, cheat, or exploit the App
• Interfere with other users’ enjoyment of the App
• Share your account with others
• Use automated systems to access the App
• Reverse engineer or decompile the App
• Post offensive, abusive, or inappropriate content

Intellectual Property

Our Rights

• The App, including all content, features, and functionality, is owned by us
• All trademarks, logos, and brand names are our property
• You may not copy, modify, or distribute any part of the App without permission

Your Content

• You retain ownership of content you create (e.g., profile photos)
• By using the App, you grant us a license to use your content to provide services
• You represent that you have the right to grant this license

Disclaimers

Service Availability

• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue features at any time
• We are not liable for any loss resulting from service interruptions

Game Outcomes

• Game outcomes are determined by random number generation
• We do not guarantee any specific results
• Past performance does not guarantee future results

Platform Services

• Apple, Google, authentication providers, analytics vendors, and ad providers operate their own services under their own terms and policies
• We are not responsible for outages or policy changes affecting third-party platforms or services outside our control

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App in the past 12 months
• Some jurisdictions do not allow limitations of liability, so these limitations may not apply to you

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Termination

By You

• You may stop using the App at any time
• You may delete your account through the App settings

By Us

We may terminate or suspend your access if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We discontinue the App or service

We may also remove or limit access to specific features, purchases, or rewards where necessary to protect platform integrity, security, or the player experience.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

• Updating the “Last Updated” date
• Posting a notice in the App (where applicable)
• Sending an email notification (for major changes)

Continued use of the App after changes constitutes acceptance of the new Terms.

Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Process

2. If unresolved, disputes may be resolved through binding arbitration

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Apple App Store Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• If the App fails to conform to any warranty, you may notify Apple for a refund
• Your use of the App also must comply with Apple’s applicable terms, including the Apple Media Services Terms and the Licensed Application End User License Agreement (EULA) where Apple makes them apply — see Apple’s terms for apps from the App Store

Google Play Store Terms

If you downloaded the App from Google Play:

• These Terms are between you and us, not Google
• Google is not responsible for the App or its content
• Google has no obligation to provide support for the App
• Your use of Google Play is also subject to the Google Play Terms of Service and related policies — see Google Play terms
